Sobriety Checkpoints in Fresno and the Central Valley

A sobriety checkpoint is a fixed location set up by law enforcement officials to stop vehicles and ascertain if the driver is operating the vehicle under the influence of alcohol or drugs. 

There has been many legal challenges to such checkpoints as they potentially infringe upon fourth amendment constitutional rights.  The Supreme Court has ruled upon the constitutionality of Sobriety Checkpoints and certain requirements are placed upon law enforcement to operate such checkpoints.

This would include, but is not limited to:

  • A random / impartial method of stopping vehicles (e.g., stopping every third vehicle)
  • There must be a turnout to avoid the checkpoint and you cannot be stopped for merely using the turnout;
  • There must be public notification of the Sobriety Checkpoint (e.g., radio ads);
  • Hours for operating the Sobriety Checkpoint must be reasonable.

If law enforcement violates such a requirement, any stop or arrest could be held to be unconstitutional.
