DUI Penalties in Fresno County and the Central Valley

Penalties for Driving Under the Influence (DUI) may vary slightly; however, the basic penalties are for a California DUI Conviction are listed below:

First  DUI Offense (within 10 years)

  • Court Probation generally for 3 to 5 years
  • Attendance of drug / alcohol classes from 3 to 6 months (you pay the costs)
  • Suspension or Restriction of Driver's License
  • 48 hours of mandatory jail time
  • Community Service (May be able to obtain community service time in lieu of jail time)
  • Fines and court fees of $1,400 to $1,800

Second DUI Offense (within 10 years):

  • Court Probation generally for 3 - 5 years
  • Attendance of drug / alcohol classes for 18 months (you pay the costs)
  • Suspension or Restriction of Driver's License
  • Fines and court fees of $1,800 to $2,800
  • 96 hours to 30 days of mandatory jail time
  • Community Service (May be able to obtain community service time in lieu of jail time)

Third DUI Offense (within 10 years):

  • 3 to 5 years of Court or Formal Probation
  • Attendance of drug / alcohol classes for 18 months (you pay the costs)
  • Suspension or Restriction of Driver's License
  • Ignition Interlock Device
  • Fines and court fees of between $1,800 to $2,800
  • 120 days of mandatory jail time
  • Community Service, Rehab Programs (May be able to obtain community service time  or in house rehabilitation in lieu of some jail time)

Fourth DUI Offense (within 10 years):

  • Felony charges
  • 1 to 5 years in a State Penitentiary
  • License suspension for up to 4 years
  • 18 months of mandatory alcohol classes
  • AA meetings
  • Fines and court fees of between $1,800 - $2,800

The following factors can enhance penalties:

  • Causing an auto accident resulting in serious injury or death;
  • A Blood Alcohol Concentration of .16% or greater;
  • A minor under the age of 14, as a passenger in the vehicle during the DUI offense;
  • Prior DUI convictions.

In additions to the above listed penalties, a judge may order an Ignition Interlock Device to be installed in your vehicle (once again your cost) and mandatory AA meetings.
