If you have been arrested in Fresno, Clovis, Madera, Oakhurst, Bass Lake, Merced, Visalia, Tulare or the surrounding areas, and arrested from Driving Under the Influence of Alcohol or Drugs (DUI), your are required to allow a test to determine your Blood Alcohol Concentration (BAC).
There are two standardized methods of BAC testing in California:
Breath Testing: Generally after your arrest, you will be required to blow into a device that measures your BAC. Such a test can be administered at the scene of your arrest or you may be transported to another location to take the test (e.g., the jail). You can refuse to take such a test prior to your arrest; however, should you refuse after your arrest you can lose your driver's license for up to one year.
Blood Testing: The taking of blood is more accurate than a breath test. A qualified individual will take your blood and the sample is sent off to a lab for testing. Normally two vials are drawn and you have the right to request independent testing of your blood.
